Our services and these terms

Persistence of Vision (Persistence of Vision Previs, LLC, “we,” “us,” or “our”) operates ZAFARI.com and ZAFARI TREK. These Terms of Use cover our website, games, learning services, account features, and related content (the “services”). By using the services, you agree to the terms that apply to your use. If you do not agree, do not use them.

Parents and guardians are responsible for deciding whether and how their children use the services. The Privacy Policy explains information handling, and the Legal Notices identify applicable third-party terms and attributions.

Parents, children, and account security

You must be an adult parent or guardian, or otherwise legally able to enter this agreement, to create and manage a family account, authorize a child’s participation, or purchase access. Children use the child experience with their parent or guardian’s permission and supervision. They do not create independent parent accounts.

Provide accurate account information and keep parent credentials, family codes, and explorer PINs secure. Do not share access with unauthorized people or use another family’s account. Contact us if you suspect misuse. We may verify account ownership before making sensitive changes or fulfilling data requests.

Apple app license

The ZAFARI iPhone and iPad apps use Apple’s standard Licensed Application End User License Agreement. That agreement governs the license to the downloaded Apple app. We do not provide a separate custom app EULA through this website.

These terms govern the associated ZAFARI website and services. They do not replace, amend, or limit Apple’s standard EULA or override rights under Apple’s applicable terms. If a provision here conflicts with the Apple app license, the Apple agreement governs the software-license issue.

Access, billing, and cancellation

Some content is available without an account. TREK account features require a parent account and applicable permission or entitlement. Free or beta access may be limited or change; the offer and checkout explain the access being provided. Native apps connect to an existing family account; account creation and website billing take place on the website.

If you choose a paid subscription, checkout shows its price, billing interval, renewal conditions, and applicable taxes before purchase. Stripe processes website payments. A recurring plan renews as disclosed at checkout until canceled. Where available, use “Manage subscription” in the parent dashboard to open the billing portal, or contact us for help. Any trial or promotional conditions are those shown when accepted.

Subscription cancellation, child-data deletion, and parent-account deletion are separate actions. Review your billing status before deleting an account. Refund and cancellation rights are subject to the purchase terms and mandatory consumer law. These terms do not waive any statutory refund or withdrawal right.

ZAFARI content and family submissions

ZAFARI characters, artwork, videos, music, stories, games, trademarks, and other service materials belong to their respective owners or licensors. You may access the services for their intended personal, family, or expressly offered educational use. Downloads and printables may be used as permitted with the particular activity. Do not sell, redistribute, or commercially exploit protected materials without permission.

You retain any rights you have in the text or other information you supply. You authorize us and our service providers to process, host, store, reproduce, and display that information only as needed to deliver and support the requested features and comply with law, as explained in the Privacy Policy. Do not submit material you lack permission to use or unnecessary sensitive information about a child.

Generated assets may incorporate licensed ZAFARI material and third-party technology. Their availability does not grant ownership of ZAFARI characters or promise exclusive intellectual-property rights in AI output. Open-source software and fonts remain subject to their own licenses; these terms do not restrict rights granted by those licenses.

Acceptable use

Do not use the services unlawfully, harass or exploit others, submit harmful or infringing material, interfere with service operation, distribute malware, bypass access controls or safety checks, or attempt to access another family’s information. Do not scrape personal information or misuse child-facing features. Restrictions apply only to the extent allowed by law and applicable third-party licenses.

Personalization, learning, and rewards

TREK provides playful learning activities and progress summaries. It does not provide medical diagnosis, professional assessment, or a guarantee of educational outcomes. Parents should review activities and support children appropriately.

Optional Zoomba name audio is synthesized through ElevenLabs from parent-provided text. Avatar and printable generation can use AI image services. Generated content can contain mistakes; contact us about unsuitable output. The child experience does not offer public child profiles or direct messaging.

Digital rewards recognize the activity described and are not money. Physical reward eligibility, supported delivery regions, and fulfillment conditions are those stated in the applicable offer. Parents supply delivery details when requesting an eligible reward. Do not assume that every digital achievement includes a physical product.

External services and privacy

YouTube playback is subject to the YouTube Terms of Service and Google Privacy Policy. Other linked services have their own terms and policies. Network requests can occur when previews, images, or players load. We do not control third-party service availability or information handling.

Read our Privacy Policy for child and parent data, providers, storage, retention, and parent rights. A grown-up navigation check in the app is separate from parental consent to collect or use information.

Ending access and deleting information

You can stop using the services. Parent controls and privacy requests provide options to review, correct, or delete information and refuse further collection. Withdrawing consent stops authorized child access but does not itself erase stored records. Downloading a file, signing out, uninstalling an app, deleting data, and canceling billing have different effects.

We may restrict or end access for misuse, security concerns, legal requirements, or service discontinuation, subject to applicable law and paid-access obligations. Where appropriate and legally permitted, we will explain the action and available next steps. Ending access does not remove privacy rights or mandatory consumer protections.

Availability and responsibility

We work to keep the services useful and available, but availability, device compatibility, content, and features can change. To the extent permitted by law, website and service features are provided “as is” and “as available,” without a promise of uninterrupted or error-free operation.

To the extent permitted by law, we are not liable for indirect, incidental, special, or consequential losses arising from use of these website and service features. Nothing here excludes liability or a warranty that cannot lawfully be excluded, or limits mandatory consumer rights. The separate Apple app license governs its own warranties and liability provisions.

Applicable law and changes

These website and service terms are governed by California law, excluding conflict-of-law rules, except where mandatory law gives you protections under another law. The Apple standard EULA contains its own applicable-law provisions for the app license.

If a provision cannot be enforced, the remaining terms apply to the extent permitted by law. We will update the date when these terms change and provide notice or obtain agreement where legally required. Changes do not remove accrued rights or retroactively waive mandatory protections.
